PREAMBLE
|
|
|
|
We, the Associated Students of Spokane Falls Community College do ordain and establish
the Constitution stated below to ensure that we, as students at Spokane Falls Community
College, are suitably represented and exercise our right of free inquiry and free
speech in a responsible manner; to participate in decisions concerning our education
at Spokane Falls Community College; to better college-community relations; and to
provide varied opportunities for the continuing, personal social, educational, recreational,
and cultural development of the students, do hereby establish this Constitution.

|
ARTICLE I
|
|
NAME
|
|
|
|
The name of this organization shall be the Spokane Falls Community College SFCCAS,
hereinafter referred to as the SFCCAS.
|
|
|
|
ARTICLE II
|
|
AUTHORITIES AND POWERS
|
|
|
|
Section 1. Charter
|
|
The SFCCAS is established under the terms of a charter granted by the Washington
State Community College District 17, and the acts and functions of the SFCCAS shall
be subject to such conditions and limitations as may be prescribed by the charter
through its Board of Trustees.
|
|
|
|
Section 2. Approval
|
|
All of the acts and functions of the SFCCAS and its subsidiary agents or agencies
shall be subject to the approval of the Washington State Community College District
17 Board of Trustees. Disapproval of an act or function of the SFCCAS shall require
a two-thirds majority vote of the College Administrators; this action may be appealed
by SFCCAS Senate to the College President, District CEO/Chancellor, and finally
to the Board of Trustees.

|
Section 3. Powers
|
|
All powers granted herein shall be vested in the SFCCAS Senate. This body is a single
legislative body.
|
|
|
|
ARTICLE III
|
|
MEMBERSHIP
|
|
|
|
All students of Spokane Falls Community College, upon paying quarterly tuition and
fees and/or holding a current SFCC Identification Card, shall be members of this
organization and subject to the Rules of Conduct and Procedures of Enforcement,
Community Colleges of Spokane District 17.
|
|
|
|
ARTICLE IV
|
|
FEES
|
|
|
|
Section 1. Services and Activities (S&A) Fees
|
|
SFCCAS membership fees are paid quarterly, in the form of Services and Activities
Fees as specified by state law. This includes Running Start and International Students.
|
|
|
|
Section 2. Student Government Work Grants
|
|
The SFCCAS Senate shall make available to elected and appointed SFCCAS officers,
S&A work grants, as specified in the District 17 Financial Procedures Manual for
Services and Activities Fees, and in the SFCCAS S&A Budget Book.
|
|
|
|
ARTICLE V
|
|
SFCCAS SENATE OFFICERS/ELECTIONS
|
|
|
|
Section 1. Oath of Office
|
|
Prior to taking office, every member of the SFCCAS Senate will publicly pledge or
affirm the following oath of ethical leadership and conduct:
"In consideration for the privilege of being a participating member of the SFCCAS
Senate, I promise to execute my duties to the best of my ability; maintaining the
highest standard of ethical conduct and always placing the interests of the Spokane
Falls Community College Student Body before my own."

|
Section 2. Requirements of SFCCAS Officers
|
- Membersof the SFCCAS must:
Be a full time student (10 or more credits);
Candidates must have a cumulative college GPA of 2.5, or better.
Members must maintain a quarterly college GPA of 2.5, or better.
- Academic Probation
Any Senate member not meeting the above requirements may appeal to the SFCCAS Senate
for probation, which may be granted one time per academic year.
- In order to be granted probationary status, the SFCCAS officer must submit a written
request to the AS President prior to the start of the following quarter. The SFCCAS
President shall consult the Associate Dean of Student Funded Programs and bring
a recommendation to the SFCCAS Senate.
- Senate must pass a motion, by secret ballot, with 2/3 of the voting members (excluding
the member requesting probationary status) approving of the request.
- Criteria for accepting a request is as follows:
- Any member who's quarterly GPA falls below a 2.5 and who's cumulative GPA remains
at or above 2.5.
- Any member who receives an incomplete or Z in a class causing his/her credit load
to fall below 10.
- Any member who's cumulative GPA falls below 2.5 due to medical or family emergencies.
Documentation is required.
- For an officer whose situation does not fall within the general criteria.
- An officer whose situation does not fall within the general criteria may bring
his/her petition before the A.S. President and the Associate Dean of Student Funded
Programs, where a recommendation will be made on the merits of the request.
- The Senate will then vote on the recommendation of the A.S. President and the
Associate Dean of Student Funded Programs.
- If the petitioner does not agree with the recommendation or the Senate’s vote,
the petitioner may request an executive meeting of the Senate will full disclosure
of the petitioner’s request.
- All conditions and monitoring of probationary status will be established and performed
by the Associate Dean of Student funded programs and the A.S. President on a case
by case basis.

Section 3. SFCCAS Elected Senate Officers with Voting Rights
|
- SFCCAS President (will vote only in the case of a tie)
- SFCCAS Academic Vice-President
- SFCCAS Activities Vice-President
- Associated Women Students President (AWS)
- Associated Men Students President (AMS)
|
|
Section 4. SFCCAS Appointed Senate Officers with Voting Rights
|
SFCCAS President shall appoint officers with voting rights, from a list of qualified
students and submit to Senate (via Executive Council) for approval. There will be
sixteen (16) voting Senate members, with SFCCAS President voting to break any ties.
The Senate will approve appointees no later than the third (3rd) week of the quarter,
and within ten (10) academic days of any vacancy, given a qualified list of candidates.

- Senators: Four(4) to be designated by campus district.
- Senator of Library, Business, and Communications.

(Buildings 7, 13 and 16)

|
Section 6. Duties and Powers
|
- SFCCAS President
- Shall preside at the meetings of the SFCCAS and the SFCCAS Senate.
- Shall be the chairperson of the SFCCAS Senate Executive Council.
- Shall have no vote in the Senate except in the case of a tie vote.
- Shall sign all documents approved by the Senate.
- Shall have veto power over all actions of the Senate provided that notice of such
veto is distributed to SFCCAS Senate officers no later than five (5) academic days
following the enactment. If the President takes no action within five (5) academic
days, the action shall be considered approved.
- The Senate may override a Presidential veto by two-third (2/3) majority vote.
- Shall attend Board of Trustees meetings and be responsible for representing the
SFCCAS on this Board.
- Shall be responsible for reporting the business of the Board of Trustees to the
Associated Students.
- Shall be responsible for reporting the business of the Associated Students to
the Board of Trustees.
- Shall appoint the JUDICIAL BOARD from students at random, as needed, for the current
academic year.
- Shall be available to evening students.
- Shall have spending authority as described under Article 12, section B.
- Shall approve SFCCAS Senate member timesheets.
- SFCCAS Academic Vice-president
- Shall be a voting member of the Senate.
- Shall be a member of the Senate Executive Council.
- Shall assume all duties of President in his/her absence.
- Shall succeed the president if he/she becomes unable to perform his/her duties.
- Shall appoint student members to college and district committees as required.
Shall be chair of Election Committee, unless running for office (as outlined in
Art, XI, Section 1).
- Shall be responsible for the representation of evening students by means of evening
staffing of student representatives and/or other available resources.
- Shall be manager of the SFCCAS District Senators and meet weekly to coordinate
their activities and resources.
- SFCCAS Activities Vice-president
- Shall be a voting member of the Senate.
- Shall be a member of the Senate Executive Council.
- Shall be the chairperson of the Activities Board, and will vote only to break
any ties.
- Shall have the power to recommend activities and programs from the activities
Board to the Senate. Shall be responsible for ensuring that all events for the student
body are adequately publicized.
- Shall meet with evening students as required.
- Shall be manager over Student Activities Office appointees there under.
- After consultation with the Coordinator for Student Activities, shall appoint
the Activities Board Secretary, Activities Board Public Information Officer, four
(4) Programmers (lecture, concerts/comedy, special events, outreach/education),
a Stage/Audio technician and may make appointees as deemed necessary by SFCCAS Senate.
Appointments will be made no later than the second (2) week of Spring Quarter or
within ten (10) academic days of a vacancy so long as qualified applicants exist.
- Shall act as the primary liaison between SFCCAS Senate and the Activity Board
- Shall approve SFCCAS Student Activities member timesheets.
- SFCC Associated Men/Women Students President
- Shall be a voting member of the Senate.
- Shall be a voting member of the Activities Board.
- Shall be a member of the Senate Executive Council.
- Shall be student representatives to SFCC graduation committees.
- Shall be available to evening students as required.
- Shall be responsible in seeking student representation on campus committees as
deemed appropriate.
- SFCCAS Secretary
- Shall be a voting member of the Senate.
- Shall be a member of the SFCCAS Senate Executive Council.
- The Senate Secretary shall be responsible for maintenance and publication of minutes,
agendas and compiling of reports.
- Shall be responsible for other duties as assigned by the SFCCAS President and
SFCCAS Academic Vice President, and shall act as support to other SFCCAS Officers.
- Shall be a member of the Judicial Board and keep record of any SFCCAS Senate or
Judicial Board proceedings.
- Shall be chair of the Election Committee (in the case that the SFCCAS Academic
Vice President is running for elected office) and shall appoint four (4) members
at random) as outlined in Article XI, Section 1.
- Qualifications for the secretary will include a demonstration of proficiency in
computer applications, and office management skills.
- SFCCAS Treasurer
- Shall be a voting member of the Senate.
- Shall assist Student Funded Programs Staff and club treasurers in the accounting
of SFCCAS S&A funds.
- Shall sign all SFCCAS Support purchase requests and present same for co-signature
of the SFCCAS Senate Advisor.
- Shall receive and file financial reports of all activities receiving SFCCAS S&A
funds.
- Shall submit a brief financial report monthly to the Senate.
- Shall be a member of the Senate Executive Council.
- Shall be a member of the Joint-Service and Activity Fee Budget Committee (JSAFBC).
- Shall approve timesheets for SFCCAS Senate and Student Activities Officers.
- Qualifications for the treasurer will include a demonstration of proficiency in
computer applications and accounting.
- Associated Student (AS) Club Representatives & Instructionally Related Programs
(IRP) Club Representatives
- Shall be voting members of Senate.
- Shall be voting members of the Activities Board
- Shall attend all meetings of Activities Board and SFCCAS Senate.
- Shall be elected from Activities Board.
- Shall be a supporter of club representation by checking attendance, retrieving
reports from absent club from Activities Board, utilizing Activities office mailbox
for communication and insuring clubs are taking part in special event activities
throughout the year, particularly “Club Days.”
- Shall be a participating member of the JSAFBC board.
- Legislative Liaison
- Shall be a voting member of the Senate.
- Shall be the official Senate representative and contact regarding legislative
issues, concerns and business relating to community college students.
- Shall represent the Senate on college, district, city, state and national legislative
committees, task forces and other organized groups involved with the legislative
process.
- Will represent and carry forward the Senate position on all legislative business
to the appropriate levels of government.
- Will serve as a liaison between other student governments within the Community
Colleges of Spokane and serve on the Legislative-steering Committee.
- SFCCAS Public Information Officer
- Shall be a voting member of the Senate.
- Shall be a member of the Senate Exec. Council.
- Shall be the Senate representative in charge of publicizing all Senate events
and activities.
- District Senator Representatives
- Shall be voting members of the Senate.
- Shall represent students within their respective district and be responsible for
reporting information back to the Senate.
- Shall meet with their respective Deans and Department Chairs weekly.
- Shall be responsible in seeking student representation on campus committees as
deemed appropriate.
- SFCCAS Historian/Parliamentarian
- Shall be ex-officio member of the Senate.
- This officer shall assist the SFCCAS President and/or other officers to follow
parliamentary procedure during meetings.
- This officer shall maintain, a permanent historical record, of the Associated
Students and business handled by that board.
- Faculty Representatives
- Shall be voting members of the Senate.
- One (1) faculty member is to be appointed by their respective peers.
- Shall represent all faculty of SFCC and be responsible for reporting information
to and from their peers on behalf of the Senate.
- Administrative Representatives
- Shall be voting members of the Senate.
- One (1) administrator is to be appointed by their respective peers.
- Shall represent all administration of SFCC and be responsible for reporting information
to and from their peers on behalf of the Senate.
- Senate Advisor
- Shall be an ex-officio member of the Senate.
- The advisor to the Associated Student Senate is recommended to be the Associate
Dean of Student Funded Programs/Student Services.

Section 7. Elections
|
- Election Committee shall announce election rules, dates, and regulations at least
three (3) weeks prior to the election of student elected officers. The election
committee is required to publish an Election Packet in Accordance with ARTICLE XI,
Section 1, C.
- Election shall be by majority of the legal ballots cast. An elected officer must
receive one half plus one vote of legal ballots cast for that position to be legally
elected. (300 votes = 151 votes to win)
- Election of the SFCCAS officers shall be no later than the 6th week of Spring
quarter. If a runoff election is required for any office, this election shall take
place no later than the 7th week of Spring quarter between the two (2) candidates
receiving highest number of votes for that position.
- SFCCAS Senate Officers shall take office the first day of Summer quarter.
- Before a student shall be considered a candidate, a petition, in the proper form
signed by a minimum of fifty (50) members of the SFCCAS, must be presented to the
Election Committee, via the office of Student Funded Programs.
- Any member of the SFCCAS not on the election ballot may be a "write-in" candidate
for any one (1) office, provided election requirements are met (48) hours prior
to the election.
- A candidate for office must be a full-time student (10 credits or more) at Spokane
Falls Community College at least one full quarter immediately prior to and during
the quarter of candidacy and during term of office. Candidates must be continually
enrolled and satisfactorily complete ten (10) credits or more with a minimum quarterly
grade point average of 2.5 and maintain an overall Spokane Falls Community College
cumulative grade point average or 2.5, immediately prior to, and during the quarter
of candidacy.
- Any elected officer, once in office and not meeting the requirements of part G
may appeal to the Senate for probation and if granted will be on probationary status
for one quarter. Probation may be granted once per academic year. (See Art. V, Section
2. B.)

ARTICLE VI
|
|
MEETINGS
|
|
|
|
Section 1. Legal Sessions
|
|
The Senate shall sit in legal sessions at least once (1) each academic week during
Fall, Winter, and Spring quarters. A quorum, which consists of two-thirds (2/3)
occupied Senate positions, must be in attendance for business to be conducted.
|
|
|
|
Section 2. Special and Summer Sessions
|
|
The SFCCAS President, SFCCAS Academic Vice-president, or SFCCAS Activities Vice-president
may call a summer/special sessions. Written and verbal notice must be given two
(2) days prior to the scheduled summer session.
The SFCCAS Senate, prior to the end of spring quarter, will determine a date, time,
and place for a summer session of the SFCCAS Senate. Likewise, a session the SFCCAS
Senate will be determined prior to the end the session, with a minimum of 2 during
the summer quarter.

|
Section 3. Actions
|
|
All actions of the Associated Students require a vote of the majority of held positions
(half of occupied voting positions plus one) to pass.
Sessions of the SFCCAS Senate are to be conducted by parliamentary procedure as
defined by SFCCAS Officer Handbook.
|
|
|
|
Section 4. Meeting Attendance
|
- A Senate member who cannot attend a meeting must give the AS President timely
notice and state the reasons for his/her absence.
- Timely notice notwithstanding, compelling or urgent circumstances must exist to
excuse an absence.
- Unexcused absences are defined as:
- Failure to attend a regularly scheduled Senate Meeting without giving the AS President
timely notice.
- Lack of good cause for such an absence.
- Arriving at a regularly scheduled Senate Meeting after the commencement of New
Business, or departing prior to conclusion of old business without give the AS President
timely notice.
- Senate members are permitted only three unexcused absences each academic quarter.
- After the first and second unexcused absence, that SFCCAS Officer will receive,
respectively, verbal and written notice of non-attendance. On accumulating three
unexcused absences, that SFCCAS Senate officer is:
- Automatically declared a non-participant in SFCCAS Senate.
- Considered to have voluntarily resigned from office.

ARTICLE VII
|
|
SENATE
|
|
|
|
Section 1. Definition
|
|
The SFCCAS Senate shall be the official governing body of the SFCCAS of Spokane
Falls Community College and shall be the focal point of the decision making process
of the SFCCAS population.
|
|
|
|
Section 2. Approval of Appointed Officers
|
- The Senate shall approve by a majority vote, in legal session all appointments
made by the SFCCAS President to determine acceptance of such appointments.
- The following is the procedure that the SFCCAS President with the help of the
Academic Vice President, shall follow in appointments for all offices paid by S&A
Fee Grants and State Work-study. The SFCCAS President may terminate the appointment
process at any time until the actual appointment. All officers are to be held to
the requirements as described in the SFCCAS Constitution under Article 5, Section
2.
- All new applications will be brought to the Student Funded Programs Office to
verify the applicants SFCCAS academic eligibility.
- Once the applicants SFCCAS academic eligibility has been established, an interview
will be scheduled qith the A.S. Pres., the Academic VP and the Assoc. Dean for Student
Funded Programs.
- After the initial interview, if the SFCCAS Academic Vice President and the SFCCAS
President endorse the applicant as their appointee for the applied office, the appointee
will interview with the Senate Executive Council. The Activities Vice President
need only confer with the Activities Advisor on the appointment of an Activities
Board member.
- The appointment of a Senate appointee must be placed on the agenda for the following
Senate meeting, by the Senate Executive Council.
- Once on the agenda, the Senate appointee must be approved by the Senate with a
simple majority vote. Upon Senate approval, the newly appointed Senate officer shall
read aloud and sign the Ethics Pledge then take their respective seat at the Senate
table. Newly appointed Activities Board members shall also read aloud and sign the
Ethics Pledge upon taking their respective seat at the Activities Board table.

Section 3. Minutes
|
- The Senate shall keep minutes of its legal sessions on file and shall publicize
the records within four (4) academic days.
- All Senate legal sessions as herein described shall be open to the entire SFCCAS
membership to address the Senate in each legal session.
|
|
Section 4. Archives
|
- The Senate shall keep archives of its actions to be used as reference for succeeding
administrations of the SFCCAS.
- Information held within these archives is to be made available to students and
administration through the SFCCAS Historian/Parliamentarian.
|
|
Section 5. Authorities and Powers
|
- The Senate shall have the Authority:
- To formulate rules and government for the SFCCAS and regulation of the student
welfare within the provisions of this constitution.
- To approve the SFCCAS S&A budget recommended by the Joint S&A Fee Budget Committee
and all SFCCAS S&A expenditures.
- To review the sanction of any club when the club fails to maintain the qualifications
of recognition, and to approve the sanction of new SFCC clubs.
- The Senate shall have powers as are necessary and proper under this Constitution
to perform its functions and duties.

Section 6. Senate Executive Council
|
- Purpose of the Executive Council shall be advisory in nature to the Senate.
- The Executive Council shall be composed of: Associated Student President, Academic
Vice President, Activities Vice President, Secretary, Treasurer, AMS president,
AWS President, Legislative Liaison, Public Information Officer. Other members are
encouraged to participate.
- The Executive Council is empowered, by the Senate, to conduct specific business
when deemed appropriate.
- The Executive Council will meet, weekly, prior to the scheduled Senate meeting
to establish an agenda and prepare for the forthcoming Senate meetings.

ARTICLE VIII
|
|
JUDICIAL BOARD
|
|
|
|
Section 1. Purpose
|
|
The purpose of the Judicial Board is to uphold and interpret this Constitution of
the SFCCAS, guard against infringement upon this Constitution, establish legality
of all petitions concerning the SFCCAS, act as final judge in intra-governmental
disputes, and assume any duties specified elsewhere in this Constitution.
|
|
|
|
Section 2. Membership
|
|
Membership (of seven) will consist of the SFCCAS Academic Vice President, who shall
preside; the SFCCAS Secretary, who shall assist the Academic Vice President in preparing
reports of proceedings and keep on file all reports; five (5) students chosen by
the SFCCAS President from a list of students at large, who are not members of the
Senate or Activities Board to serve as needed. The activities advisor, the senate
advisor and the SFCCAS parliamentarian are ex-officio members of the Judicial Board.

|
|
Section 3. Convening the Board
|
|
The Judicial Board shall convene within five (5) academic days of written request
from either the Senate, Activities Board, SFCCAS President, or Senate Advisor. This
Request will be sent to the SFCCAS President. Upon receipt of such request, the
SFCCAS President shall promptly notify the Academic Vice President and the Senate
Advisor in order that the students may be notified and convened.

|
|
Section 4. Voting Procedures
|
|
Decisions of the Judicial Board shall require a two-thirds (2/3) vote of the Board
(5 of 7 votes); and the decisions of the Judicial Board shall be filed with the
official copy of this Constitution and the minutes of the meetings.
|
|
|
|
Section 5. Replacement of Members
|
- When a member, or members of the Judicial Board, may be directly affected by decisions
of the Board; the member(s) will be replaced by a student(s) to be chosen by the
SFCCAS president as outlined in section 2 above.
- Members of the Judicial Board (exempting the members who "may be directly effected
by decisions of the Board") will vote, by simple majority, if a member should be
replaced.
- Judicial Board members will select a person (by simple majority) to preside as
chairperson over the proceedings when the Academic Vice President is replaced.

Section 6. Quorum
|
|
Five (5) voting members shall constitute a quorum.
|
|
|
|
ARTICLE IX
|
|
ACTIVITIES BOARD
|
|
|
|
Section 1. Composition and Purpose
|
- The Activities Board shall be a planning and recommending body.
- The Activities Board shall consist of a representative from each club and organization
of campus, and the SFCCAS Student Activities Officers and Staff.
- Representatives shall recommend student activities and programs to the SFCCAS
Activities Board.
|
|
Section 2. Appointments
|
- The Activities Vice President or the chairperson's designee, shall be the chair
of the Activities Board
- The SFCCAS Activities Vice President shall appoint SFCCAS Activities officers
as described in Article 5, Section 6.
- The Activities Board shall approve, by a majority vote, in legal session, all
appointments made by the Activities Vice President.

Section 3. Meetings
|
- The Activities Board shall meet a minimum of once (1) every academic week of Fall,
Winter, and Spring quarters.
- The SFCCAS Activities Board Secretary shall prepare agenda and minutes for all
legal sessions.
|
|
Section 4. Members Voting Rights
|
|
One representative from each Club/Organization, each programmer, the Activities
Secretary, the Activities PIO, the AWS and AMS Presidents shall have the power to
vote. The Activities Vice President shall cast a vote in the case of a tie.
|
|
|
|
ARTICLE X
|
|
CLUBS/ORGANIZATIONS/CHARTERS
|
|
|
|
Section 1. Requirements for Recognition
|
- Recognized clubs/organizations must seat one, elected representative to the Activities
Board.
- Before recognition, clubs must submit the following documentation to SFCCAS Senate
through the SFCCAS Activities Board showing:
- Constitution, statement of purpose and goals.
- Name of appointed faculty advisor to club.
- Faculty advisor must meet with both the Coordinator of Student Activities and
the Associate Dean for Student Funded Programs
- A tentative outline of activities, and a tentative budget if S&A funds are to
be requested.
- In order to become recognized, a club must first submit the appropriate document
for recognition to the Senate and receive approval of a majority of the SFCCAS Senate.

|
Section 2. Club Sanctions and Reinstatement
|
|
Before the sanction of any club may be withdrawn for not fulfilling its goals and/or
purpose, the Senate must:
- Notify said club or organization of changes against the club or organization and
set an open hearing of the club or organization five (5) academic days after notification.
- The SFCCAS Activities Vice President and the Coordinator of Student Activities
will facilitate this open hearing with the SFCCAS President.
- Two-thirds (2/3) of the Senate voting members will constitute a legal session.
Charges against the club will be discussed in an open meeting. Formal action will
be taken casting a secret ballot. Two-thirds (2/3) vote of Senate is necessary for
specific sanctions.
- If a club sanction is removed, after one (1) complete quarter, not including the
quarter of sanction removal, the club may petition for reinstatement using the procedure
under Article X, Section 1, of this Constitution.

Section 3. Attendance Requirements and Waiver
|
- Non-attendance at Activities Board meetings is a violation of this Constitution
and may lead to actions against the club and may lead to revocation of the club/organization
budget and/or charter.
- After two (2) unexcused absences, said club's advisor will be sent a letter notifying
them of their representative’s absences.
- After three (3) unexcused absences, said clubs will be notified of the pending
charges. An open, formal hearing with the SFCCAS Vice President and the Coordinator
of Student Activities must be requested within five (5) academic days of this notification.
- Said club's budget will be frozen effective the date of notification of charges.
- Purchase requisitions being processed for said club whose dated submission was
prior to notification of charges will be honored.
- Clubs and organizations that have related classes during Activities Board meeting
time written justification and present it to the SFCCAS Activities Board for action
before receiving exception status. This waiver must be renewed quarterly on a club-by-club
basis to maintain exemption status. Clubs with exemption status must submit a club
report to the Activities Secretary by the day before the regular scheduled SFCCAS
Activities Board weekly meeting.

ARTICLE XI
|
|
COMMITTEES
|
|
|
|
Section 1. Election Committee
|
- Composition
The election committee consists of 5 members, including 4 students selected at random
from a list of qualified applicants by the committee chair.
- Purpose
To conduct yearly Associated Student Elections and serve as the final authority
concerning all campaign rules, regulations and issues.
- Election Packet
The election committee will develop one "Election Packet" to include but not limited
to, a description of elected positions, responsibilities of officers, eligibility,
timeline, campaign rules, election booth rules and petition for election. The packet
will be submitted to the Senate for approval no later than the last Senate meeting
of Winter quarter.

Section 2. Committee Formulation
|
- The SFCCAS President and SFCCAS Senate has the power to establish committees that
are necessary and proper to conduct Associated Student business.
- The SFCCAS Senate Committees must include but are not limited to those committees
listed in the SFCCAS Senate Officers Handbook. This list of campus committees is
to be updated annually by the end of Spring quarter with a description of the business
handled, a list of contacts, the membership, and the status of the committee’s responsibilities.

ARTICLE XII
|
|
FINANCIAL PROCEDURES
|
|
|
|
Section A. Guidelines
|
|
The Associated Students will follow published guidelines and procedures governing
the establishment and funding of programs and activities supported by Services and
Activities (S&A) fees as specified in Washington State Community College District
17 Financial Procedures manual for Services and Activities Fees and the Joint S&A
Fee Budget Committee Budget Guidelines.

|
Section B. Presidential Spending Authorization
|
The Associated Student President shall be authorized to approve funding requests
not to exceed $300 without prior approval of the AS Senate. This requires the AS
President to keep a written log of all such transactions involving AS funds. This
log shall include, but not limited to the following information:
- Amount of funds requested
- Purpose of funds
- Budget number (i.e. A.S. Contingency, A.S. General, etc.)
- Names and signatures of all interested parties
- Terms, if any, for repayment
- One witness is mandatory to co-sign the PR or IR
This log must be maintained and deposited with the AS Treasurer. Any member of the
Senate may inspect it upon demand; and, its activity will be included in the weekly
Treasurer's report to Senate.

ARTICLE XIII
|
|
VACANCIES
|
|
|
|
Section 1. Presidential Succession
|
- In the event the office of the SFCCAS President is vacated, the Academic Vice
President shall succeed to the office of President; and the new President shall
promptly appoint an Academic Vice President within ten (10) academic days. This
appointment is subject to two thirds (2/3) approval of the Senate.
- Should both the offices of SFCCAS President and SFCCAS Academic Vice President
be simultaneously vacated, the Activities Vice-president shall call for a special
election within ten (10) academic days. The Activities Vice President shall act
as interim president during this time.

Section 2. Appointments to other Vacant Positions
|
- Vacancies in other positions shall be filled by Presidential appointment within
ten (10) days, so long as qualified applicants exist.
- Appointments to vacated or unfilled elected and appointed positions must be approved
by 2/3-majority vote of the senate.
|
|
ARTICLE XIV
|
|
INITIATIVE/REFERENDUM/RECALL
|
|
|
|
Section 1. Initiative
|
- Legislation may be initiated by the SFCCAS by submitting a petition to the Senate
in the "proper form" signed by not less than ten percent of the quarterly enrolled
students (Approx. 500 students).
- The Judicial Board shall approve or reject the proposed legislation and so announce.
|
|
Section 2. Referendum
|
- All legislation is subject to referendum by petition in the proper form submitted
within fifteen (15) academic days of enactment, signed by not less than three -hundred
(300) quarterly enrolled students and presented to the Academic Vice-president.
- The Academic Vice-president shall direct the Election committee to hold a special
election within fifteen (15) academic days upon receiving the referendum.
- The Senate may also recommend any legislation for a referendum vote approval of
two-thirds (2/3) vote.

Section 3. Recall
|
- The Senate may recall any elected/appointed/ex-officio SFCCAS officer. Before
recall action is taken the Judicial Board will be called to investigate the allegation(s).
- The Judicial Board will report to the Senate, in legal session, their recommendation
to initiate recall or to stop proceedings.
- Prior to initiation of proceedings, the Senate will vote upon the recommendation(s)
of the Judicial Board. A two-thirds (2/3) vote of the total Senate is required to
proceed.
- The Senate, in legal session, will notify the officer of charges and set an open
hearing date within five (5) academic days after notification.
- Two-thirds (2/3) of the Senate voting members will constitute a legal session.
Charges against the officer will be discussed in an open hearing. Formal action
will be taken by casting a secret ballot. Two-thirds (2/3) vote of the Senate is
required for recall action to be taken. If recall is approved, the officer will
be removed from office immediately.

ARTICLE XV
|
|
AMENDMENTS
|
|
|
|
Section 1. Constitutional Amendments
|
|
A recommendation to amend this Constitution may be proposed by two-thirds (2/3)
vote of the Senate, or by a petition with signatures from three hundred (300) of
the quarterly enrolled students. Constitutional amendments will be included on the
ballot for annual election of A.S. officers and must be passed by a two-thirds (2/3)
majority of those students voting, with a minimum of three hundred (300) of the
quarterly enrolled students voting.

Section 2. Posting of Amendments
|
|
Any proposed amendment must be published and posted for ten (10) academic days prior
to election.
|
|
|
|
Section 3. Adoption
|
|
A two-thirds (2/3) affirmative vote of the SFCCAS voting is required to adopt any
amendment, with a minimum of three hundred (300) of the quarterly enrolled students
voting.

|
|
ARTICLE XVI
|
|
RATIFICATION
|
|
|
One (1) amendment was voted on and approved by the SFCC student body during the
general student election, May 10, 2005.
This document was moved and approved by two-thirds (2/3) vote of the SFCCAS Senate
on May 26th, 2005.
This constitution shall be in effect May 26, 2005.
